A businessman and politician, Mr Isaac Fayose has challenged the retaining of Ayu as party chairman and Atiku’ s emergence as Presidential flag bearer for general elections.
Mr Fayose dragged both the National Chairman of the Peoples Democracy Party, PDP, Mr Iyorchia Ayu and the Presidential candidate, Alhaji Atiku Abubakar to the Federal High court sitting in Abuja.

He pleaded the court to determine whether the respondents were not in violation of 1999 constitution as amended, as well as the Federal character bearing in mind that they were both from nothern Nigeria.
Mr. Fayose requested the court through the suit for an injunction to restrain Mr Ayu from being the National Chairman of the party pending the conduct of an emergency national convention to elect a new chairman from the south region.
